Temporary Activity Short Stay Specialist (Class GA) Subclass 400 Visa

This subclass 400 Australian Visa enables employers to sponsor a skilled worker with highly specialised work for a period up to 6 months. For a stay period longer than 3 months, a strong business case must be provided with the application. The stay period starts when the visa holder arrives in Australia.

Highly specialised skills, knowledge or experience

You can apply for the 400 Australian visa if you have specialised skills, knowledge or experience that can assist an Australian business who can not reasonably find the skilled worker to do that task in the Australian labour market. This work must be non-ongoing. Non-ongoing work means work that is likely to be completed within 6 months or less and you are not expected to stay in Australia after this time for any reason related to that particular work. The nominating business in Australia will need to show that they have tried to find Australian workers to the work first, as this can not be granted if it affects employment or training opportunities for Australian citizens or permanent residents.

Including Family Members

If you have spouse/partner and kids, they can also be included in your subclass 400 visa application before a visa is granted. However family members granted subclass 400 visa are not permitted to work in Australia.

Visa Holders Work Rights in Australia

The visa holders will have full work rights in Australia and must continue to work with their nominating employer in a temporary, short-term, highly specialised job.

Base application charge: A$415; Additional applicant charge for an applicant who is at least 18: A$415; Additional applicant charge for an applicant who is less than 18: A$105.

Subclass 400 processing time: 50% of applications in 10 Days, 90% of applications in 20 Days.

If granted this visa will have condition 8107 and 8303 imposed.
Condition 8107: Visa holder must not cease to be employed by the employer in relation to which the visa was granted. The visa holder's position or occupation must remain consistent with the position and occupation in relation to which the visa was granted.
Condition 8303: The visa holder must not become involved in activities disruptive to, or violence threatening harm to, the Australian community or a group within the Australian community.

Subclass 400 visa to 482 visa

If condition 8503 is imposed then applicant will not be able to apply for any other visa other than a protection visa, after entering Australia.

Australia 400 visa salary

Applicant's nominating employer or their overseas employer can pay the applicant.

Other 400 visa Australia requirements

You can apply for a subclass 400 visa to direct, produce or have any other role in a production that will not be shown in Australia, come to Australia for a promotional activity. The subclass 400 visa does not allow a person to:
1. Perform as an entertainer in Australia or support an entertainer or group of entertainers performing in Australia.
2. Direct, produce or take any other part in a production that will be shown, broadcast or performed in Australia (including theatre, film, television, radio, concert or a recording). If you intend to any of the prohibited activities then subclass 408 visa is more appropriate option.

Subclass 400 Visa Document Checklist

For all Applicants to be included in the application

1. Identity documents such as passport, birth certificate, proof of name change such as marriage or divorce certificate.
2. If you are or have been married, widowed, divorced or permanently separated, provide proof such as marriage certificates, divorce documents, death certificates, separation documents or statutory declarations.
3. Provide an overseas police certificate from every country, including your home country, where you spent a total of 12 months or more in the last 10 years since you turned 16, any military service records or discharge papers if you served in the armed forces of any country.
4. Passport size photographs.

For Primary Applicant

5. All academic certificates and transcripts.
6. Employment reference letters and evidence of payslips.
7. English test results such as IELTS or PTE Academic or TOEFL or OET.
8. Any professional registration or license certificate.
9. Your curriculum vitae or resume that includes your full employment and educational history, including dates and positions held within last ten years.
10. Bank statements, tax records and superannuation record (If Skills Assessment is required).

All documents are to be color pdf files. Where documents are not in english, an authorised translated version needs to be provided.
